Does the consitution law out an individuals rights or the governments rights?
A previous question askied what constitutional right would you give up. I answered that the constitution covers what the governments rights are not whta the individuals is. and of course i got a bunch of thumbs down. people dont know what the constitution even is apparently.
Here is the text of the first amendment... you tell me is it talking about what individuals can and cannot do or is it talking about what government can and cannot do
"Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances"

They ensure your rights to life, liberty and the pursuit of happiness. The only responsibilities of an American are to respect these rights. So no laws are constitution unless they protect these rights.

First of all Governments cannot have rights, only people can. The Constitution and it's amendments state that the government cannot abridge these rights.
Listen to the Declaration of Independence " all men (not governments, or animals ) are endowed by their creator with certain inalienable rights, among these are life, liberty and the pursuit of happiness"
Governments make laws they do not have the right to do anything, only the people with their rights give the government power to act on those laws..

Absolutely the constitution specifies ONLY what the federal government can do -- and further says that anything NOT specified, is allocated to the States or the People. It's a "negative document" just like Bwaak said. That's why statists like Obama and Bush, and most of Congress, have to selectively ignore the 10th amendment.

Funny thing, even if you give a right up you still actually have it. You merely have chosen not to use it or avail yourself of it. Like voting. Even if you refuse to vote. You still have the right to.
Being our Constitution does not grant Rights. It merely spells them out as self evident and that we are born with them. The Constitution is a writ of restraint upon the power of government. A writ of Shall Not's for the government to obey. Because the People are the Power. Not The State.
