How can I fight this eviction? ?

I live in government housing. The long story of this time I've been here is it was rough. I'm pretty sure that the renter can't just evict you and not be trying to work out any problems when you're trying to do everything you can not to be evicted, at least to the point that it might just end up in court that does look bad. I felt I was aware of this that in order to be evicted they have to take you to court just to do it if you're not leaving willingly. Well, I have a pretty good feeling that all these people trying to evicted me for, is just because they don't like me and they're unreasonably out to get me. They've tried to say I was evicted before just because someone a neighbor thought they heard me talking about killing people, they didn't even give me a notice they just tried intimidating me out. Also I thought there's a no eviction term happening, I live in texas right outside of Houston, I was wondering about that. They then said, that my place was giving the lady next door maggots crawling out of my walls, I never had maggots though that were just crawling all over my floor. I passed the inspection, but then this just happened, a few days ago the maintenance man came to my door to tell me that I had to clean up or I was about to be evicted, so I asked for what, that's why he said, I tried telling him I've been waiting over a week now for them to replace my door, my furniture was blocking the litter box of my cats, they said it would be about a week to do every door,

That's why my house smelled. He didn't come in or anything. I'm like it's going to smell if the litter box is right next to the door. So, that's what I said because he's telling me what he thinks he has to and I'm only trying to tell him my place ain't that dirty. But he came to my door, with the intention to threaten me being evicted just because he didn't like the smell and he hadn't even been there that whole day while they changed my door.

So now, just a few days later, no word from them at all prior to this, I was just handed an eviction just like that. It literally says on it you do not have the right to appeal of your non compliance of the October 7 eviction hold off agreement. How am I supposed to fight this.

I said, I didn't have maggots crawling on my floor. I've been trying to say that my place isn't that dirty. I haven't had many infractions, there's nothing that is reason enough to evict me in the first place, do I have to spell that out for people once again, I'm looking for a way to fight this because I haven't had many infractions, I had one inspection because they said I had maggots so then I passed that, I was waiting for them to replace my door hoping they would come sooner because.

I couldn't reach my litter box I had to move things so they could change my door, alright, so then that's when I was threatened with eviction and it was more than a threat he just said you will be evicted if you don't clean, I'm trying to say my place isn't that dirty when someone comes to your door to say you're about to get evicted. But here in this paper I got it says I can't appeal because I agreed when they gave me an inspection to keep it clean, and I passed that then. So how do I fight?

Give your landlord extra money to make a higher deposit, $1,000 if you can spare that much.  Then he will be less worried about damages.  If he still wants to evict you, go to court and tell the judge everything you said here.  Don't spare any detail.  Be sure and tell the judge that if the place was bigger, your furniture wouldn't have blocked the cat litter box and the cat would be able to use it more and that it stinks because it's a stinky cat.  Not your fault.

If your lease is up or you are month to month, they can give you notice to vacate at any time and you have to go.  IF not, then you need to violate the lease, damage property, etc.  If your place is so dirty there are maggots on the floor, you won't win.

Where to start? WHY are you in government housing? After that most of what you post doesn’t make sense. You’re pretty sure that “the renter can’t just evict you.” YOU are the renter. The other party is the landlord. Yes, you are correct. You, “the renter,” can’t just evict yourself. I own property. If you are in breach of the agreement/lease/contract OR if you are a month-to-month tenant, yes, I can evict you without a reason.

    .

So did you threaten to kill anyone? You can’t be evicted for non-payment of rent. You CAN be evicted for, again, breaching the lease/rental agreement. You “never had” maggots, but they were crawling all over your floor? That qualifies as “having maggots.” Do you mean maggots never feasted on your body, they were just all over the floor? That still qualifies as “having maggots.” So there are maggots on the floor due to your cat’s unclean - or non existent - litter box? Still qualifies as “having maggots.” Once again, on the public dole BUT can afford to feed and care for a housepet. And, in your case, more than one cat.

    .

I have no idea what the whole “replace the door deal” is. Let’s figure this out. The landlord says that your apartment smells. You say, yes, it smells, but that’s only because the cats’ litter box is next to the door. Do you really think that changes the smell? And your furniture is blocking the litter box? MOVE THE FURNITURE AWAY FROM THE LITTER BOX.

    .

Yes, I suspect “he” came to your apartment to discuss eviction, and this was NOT a social call because he was bored. I have NO idea what “non compliance of the October 7th eviction” means. It’s April. You were legally evicted in October but didn’t leave?

    .

You have no grounds to fight “this.” You CAN stay until the Sheriff’s Department physically puts all of your belongings in the street, takes the cats and surrenders them to be euthanized and changes your locks. OR you can find somewhere else to live. I don’t know if you received a 3-day notice, a 10-day notice, what you received. I’d start looking, and I’d be prepared to have a very rough time finding another place with your rental history. Oh, when you apply, try to remember you are the renter and the other party is the owner/landlord.

Talk to your social worker and/or mental health care counselor.
