can your job tell you when you can deposit or cash your paycheck?

today is payday and i went and picked up my check. todays date is on the check and they told me i couldn't deposit or cash it till we will say 3 pm and i work at 3 till after the bank is no longer open? Is this ok, legal?

    once they give you the check you can cash it. they can not prevent you from cashing the check on or after the date on the check but.......................................

    they can decide to pay you at the end of business on pay-day there is no law concerning the time of day they pay you.

    it would be better if you do as asked to prevent any problems with the check.

    in most states the law only states that paydays be at least twice a month and no more then ten days from the end of the pay-period. there are exceptions made for some who are paid on a monthly or even a quarterly basis.

    I am guessing that they do not have the money in the bank to cover the checks. I had a place do this to me. They ended up not even handing out checks until the end of the day on Friday. My supervisor was cool and would let me leave early to go to the bank. I would think that you could cash your check as soon as you get it, however, you run the risk of funds not being available. Also, you run the risk of making your employer angry.

    Sounds like the company is having financial strain, and cant coverpayroll until Monday morning.

    They can say you can not leave work to cash it, but if you are at lunch, or break, then you have every right to cash it.

    I think I'd cash it and quit.

    BTW, if you cash it and it bounces, you will have to pay the fee.

    if you go to their bank to cash it, the funds may not be available and that is why they said to wait. If you're just gonna dep it to your account, there is no need to wait because it won't clear their bank right away anyway, assuming that you don't have the same bank. but the other guy is right, if you dep the check and it's returned, there will be fees involved.
