My father passed away. I am the sole person named in the will. Can I go and live in the house?

He is behind on the mortgage and I'm going to have to talk with them. The house is in both of my parents' names and now both are deceased. Can I just go and take up occupancy? From everything I'm reading, the answer is yes. Does anyone have any light to shed on the subject?

Yes you can take up residency at the home, however ownership may not be as easy as just paying what is past due. Since he is deceased, the mortgage contract will not stay in effect. If you want to keep the house, you will be required to obtain a loan in your name so you can pay what is still owed on the home.

Yes, but chances are you will need to pay what he owes.
